Ophthalmologist Lylas Mogk, MD, filed the lawsuit in September against Henry Ford Health and Henry Ford Medical Group, claiming that the policy violates the Age Discrimination in Employment Act, the Americans with Disabilities Act, the Genetic Information Nondiscrimination Act, and Michigan’s Elliott-Larsen Civil Rights Act and Persons With Disabilities Civil Rights Act.
The policy requires all Henry Ford Medical Group members who have reached 70 years of age to complete a screening assessment for cognition, which is repeated at 75 years old and annually thereafter. The cognition assessment is conducted by the health system’s behavioral services department.
A spokesperson for Henry Ford told the Free Press it cannot comment on pending litigation.
