According to evidence at trial, Dr. Toh and others submitted over $9.5 million in fraudulent claims to Medicare and Medicaid for cancer genetic tests between March and September 2019, which were ordered despite never reviewing test results and never meeting the patients either in-person or via telehealth.
Dr. Toh was paid kickbacks by co-conspirator telemedicine companies in exchange for providing signed orders for the genetic testing. Meanwhile, the companies were paid off by co-conspirator marketing companies that targeted Medicare and Medicaid patients.
Dr. Toh will be sentenced Jan. 9, 2024, and faces up to five years in prison and a $250,000 fine for his conviction of conspiracy to violate the federal Anti-Kickback Statute.
