Austin, Texas-based Total MD Physicians Group, doing business as Total Men’s Primary Care, and physician Mason Jones, MD, have agreed to a consent judgment requiring them to pay up to $600,000 in civil penalties to resolve Drug Enforcement Administration allegations that they violated the Controlled Substances Act, the agency announced July 24.
The settlement resolves claims that Total Men’s Primary Care and Dr. Jones failed to comply with certain recordkeeping requirements and electronically signed and transmitted prescriptions for a Schedule II controlled substance without a doctor-patient relationship. DEA identified the violations during 2023 onsite inspections of three Total Men’s Primary Care clinics in Austin, Bee Cave and Cedar Park, Texas.
While the DEA’s investigation was pending in 2024, Dr. Jones voluntarily retired 14 DEA certificates of registration tied to Total Men’s Primary Care locations in Austin, Hutto, Round Rock, Georgetown, New Braunfels, San Marcos, Kyle and Cedar Park. He later surrendered four additional certificates for cause. Total Men’s Primary Care and Dr. Jones can satisfy their consent judgment obligation by paying the government $300,000 within 12 months.
